Insurance Company Bad Faith
Insurance Company Bad Faith
Insurance is purchased to protect you against unexpected accidents, injury or health problems. When your insurance company refuses to pay a valid claim under your policy, it is acting in bad faith.
As a Spartanburg/Greenville insurance fraud and abuse lawyer, and founder of the Knie & Shealy Law Offices, I have more than 35 years of legal experience. I will use my skill to advocate on your behalf to make your insurance company pay what it promised to pay in exchange for the payment of your premiums.
Helping You Recover in Cases of Bad Faith
Insurance companies are notorious for denying potentially valid claims in all areas of insurance coverage, from malpractice to terminal illness to long-term disability. This kind of behavior is insurance fraud.
In one recent case, several individuals purchased supplementary cancer policies whereby the insurance company was contractually obligated to pay the actual amount billed to the policyholder, directly to the policyholder. The policyholder was then able to use the insurance payment for whatever it was needed: the mortgage, uncovered medical expenses, etc. The insurance carrier decided that practice wasn’t profitable. While continuing to increase premiums, it cut the benefits down to what the doctor would accept for payment rather than the actual amount billed. After proving a breach of contractual obligation, I was able to get the insurance company to pay several times what was owed due to the bad faith denial.
No matter your personal circumstances, when an insurance company acts in bad faith, denying your valid claim, I can sue for insurance fraud and bad faith denial to recover:
- Actual damages, or what is owed under the policy
- Punitive damages
- Your attorney fees
When you have been denied coverage for a valid insurance claim, I will advocate strongly for the payment to which you are entitled under your insurance policy.
I can also assist when you have been the victim of a Medicaid/Medicare insurance scam.
